No. VIII (12) Import/ Tech/PN/14/2016-17/pt.II/12129-41 Dated: 24.07.2019 PUBLIC NOTICE No. 17/2019 Sub: Delegation of tasks to ACC Import Commissionerate Attention is invited to the Public Notice No, 07 / 2018 dated 07.06.2018 issued vide File C. No. CCCU(DZ)/Cus/Tech/13/2018 wherein it is mentioned that any work related to warehousing will be dealt by the jurisdictional Port of Import. On the lines of this public notice, all the functions of the Bond as mentioned below shall, henceforth, be dealt by ACC Import Commissionerate: (i) The extension in time of warehousing period in terms of Section 61 of the Act shall be granted by the Principal Commissioner/ Commissioner, ACC Import and a copy of permission so granted shall be invariably forwarded to the Principal Commissioner/ Commissioner of Customs having administrative control over the warehouse where the goods are deposited i.e. the Principal Commissioner, ACC Export; (ii) In the cases where any importer intends to relinquish the title of warehoused goods in terms of Section 68 of the Act, the same shall be decided by the Principal Commissioner/ Commissioner of ACC Import. (iii) A monthly return of the stock of the warehoused goods filed by the warehouse owner in terms of Regulation Il of the Warehouse (Custody and Handling of Goods) Regulations, 2016, shall be forwarded by the Principal Commissioner/ Commissioner of Customs having administrative control over the warehouse i.e. the Principal Commissioner, ACC Export to the ACC Import, New Customs House, New Delhi so as to facilitate them to have proper accountal of the warehoused goods and to take timely action in respect of time-expired goods pertaining to their port; (iv) As regards action in respect of time-expired goods, the proper office of ACC Import who has accepted the Bond/BG, shall issue a notice under Section 72(1) of the Act within 15 days of the expiry of permitted warehousing period to the owner/importer of the goods with a copy to the concerned warehouse owner requiring him (importer/owner) to pay the customs duty/ interest, etc., in respect of the time-expired goods within 30 days of the receipt of notice; (v) In case of failure of the importer/ owner of the time-expired goods to pay customs duty/ interest, etc., within 30 days time, a second notice in terms of Section 72(2) of the Act shall be issued by the proper officer indicating therein about the detention of the said time-expired goods and requiring the importer/ owner to submit their reply, if any, against such detention within 15 days of receipt of the notice; (vi) If the owner/ importer fails to submit any reply of the notice issued to him under Section 72(2) of the Act within 15 days time, necessary action under Section 142 of the Act shall be taken immediately by the proper officer at ACC Import, New Customs House, New Delhi and thereafter for the disposal of said time- expired goods without any further reference to the owner/ importer; and (vii) The proper officer of ACC Import, New Customs House, New Delhi shall forward the proposal for disposal of said time-expired goods to the concerned Commissionerate, as the case may be, having administrative control over the warehouse where the said goods are physically available i.e. ACC Export for taking further action. For Administrative convenience, the bond Section shall be looked after by Assistant Commissioner (EPMC) and supervised by Joint Commissioner (EPMC).
