DIN: 20230478NU00000080E4 F.No.: S/5-Gen-46/2021-22/CCSP Cell/Part-III Date: - 28.04.2023 Public Notice No. 39/2023 Sub: Issues related to port charges for DPD-CFS containers-reg Attention of the Members of Trade and Industry, Steamers/ Shipping Agents(SA), Port/Terminal Operators and CFS Operators including all other persons responsible for receipt, storage, delivery, dispatch or otherwise handling of imported goods and export goods in any capacity in a Customs area is invited to the Public Notice No. 77/2017, dated 21.06.2017 issued by JNCH for compliance of procedure for movement of import cargo in containers from Port to CFS. 2. A representation has been received about delay in clearance of containers covered under DPD-CFS from the ports to CFS. The issue has been deliberated in PTFC meeting held on 27.04.2023. After detailed consultation with stake holders present in the meeting, it has been decided to reiterate the provision contained in Para 4.4 of the said PN which is reproduced as under: For any delay in evacuation of container from Terminal (beyond free period allowed by each Terminal Operator), CFS s will be responsible for payment of Port Charges to Terminal [charged by Terminal Operator for keeping the container beyond free period). At present, Terminal are charging to shipping lines. 3. Accordingly all stakeholders especially CFSs Port Terminals are directed to ensure compliance as enumerated in Para 4.4 of Public Notice No. 77/2017 dated 21.06.2017 move the containers covered under DPD-CFS from the Port to CFS within 48 hours (Free Time). The port terminals are also directed not to insist for opening of PD Accounts to Importers/CFSs. The minutes of meeting issued on 29.03.2023 with respect to DPD-CFS stands withdrawn as necessary points have been incorporated in this Public Notice. 4. Also, a Task Force comprising of representatives of CFS, Terminals, BCBA, Shipping Lines headed by ADC(CCSP) will meet once in fortnight to discuss issues concerning delay beyond free time in clearance of DPD-CFS containers including possible waiver of ground rent beyond free time attributed to reasons beyond the control of stakeholders. 5. Difficulty, if any, faced while implementing the Public Notice may be brought to the notice of Deputy/Asst.
