8. Provisional clearance of imported goods: 8.1 Section 18 of the Customs Act, 1962 allows an importer to provisionally clear the imported goods from Customs pending final determination of value by giving a guarantee in the form of surety, security deposit or bank guarantee. Rules 4(1)(a) and 5(1) of the Customs Valuation (Determination of Value of Imported Goods) Rules, 2007 concerning identical goods and similar goods, respectively provide that the value of the goods provisionally assessed under Section 18 of the Customs Act, 1962 , shall not be the basis for determining the value of any other goods.
