MINISTRY OF CORPORATE AFFAIRS NOTIFICATION New Delhi, the 23rd January, 2018 G.S.R. 95(E).- In exercise of the powers conferred by sub-section (5) of Section 211 of the Companies Act, 2013 (18 of 2013), the Central Government hereby makes the following rules to amend the Ministry of Corporate Affairs, Serious Fraud Investigation Office, Additional Director (Capital Market)/Joint Director (Capital Market) and Additional Director (Financial Transactions)/ Joint Director (Financial Transactions) Group 'A' Post Recruitment Rules, 2015 , namely:- 1. Short title and commencement . - (1) These rules may be called the Ministry of Corporate Affairs, Serious Fraud Investigation Office, Additional Director (Capital Market)/Joint Director (Capital Market) and Additional Director (Financial Transactions)/Joint Director (Financial Transactions) Group 'A' Post Recruitment (Amendment) Rules, 2018. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Ministry of Corporate Affairs, Serious Fraud Investigation Office, Additional Director (Capital Market)/Joint Director (Capital Market) and Additional Director (Financial Transactions)/ Joint Director (Financial Transactions) Group 'A' Post Recruitment Rules, 2015, (herein after referred to as the said rules), for rule 3, the following rule shall be substituted, namely:- 3. Number of posts, classification, level in the pay matrix or pay scale. - The number of posts, their classification, level in the pay matrix or pay scale attached thereto, shall be as specified in columns (2) to (4) of the said Schedule. . 3. In the said rules, in the Schedule, - (i) in serial number 1, against the posts of Additional Director (Capital Market)/Joint Director (Capital Market), - (a) in column (1), the following Note shall be inserted, namely:- Note:- Only one post i.e. either Additional Director (Capital Market) or Joint Director (Capital Market), as the case may be, is to be operated at a time. ; (b) in column (4)- (i) for the heading, the following heading shall be substituted, namely:- Level in the pay matrix or pay scale. ; (ii) for the existing entries, the following entries shall be substituted, namely:- (i) Level 13 (Rs. 1,23,100-2,15,900) in the pay matrix for the post of Additional Director (Capital Market); (ii)Level 12 (Rs. 78,800-2,09,200) in the pay matrix for the post of Joint Director (Capital Market). ; (c) in column (11), under the heading 'Deputation (Including short-term contract) , - (i) for the words, autonomous and statutory bodies , the words, autonomous or statutory bodies , shall be substituted; (ii) under sub-heading For the post of Additional Director (Capital Market) , in clause (A), in item (ii), for the words, figures and letters, pay band-3, ₹ 15600-39100 with grade pay of ₹ 7600 , the words, figures, letters and brackets, level 12 in the pay matrix (Rs. 78,800- 2,09,200) , shall be substituted; (iii) under sub-heading For the post of Joint Director (Capital Market) , in item (ii), for the words, figures and letters, pay band-3, ₹ 15600-39100/- with grade pay of ₹ 6600 , the words, figures, letters and brackets, level 11 in the pay matrix (Rs. 67,700-2,08,700) , shall be substituted; (iv) under sub-heading Essential , after the words and brackets, Post Graduate Diploma in Management (Finance) , the words, from a recognised university or institute shall be inserted; (v) under sub-heading Desirable ,- (a) in item (i), for the words, recognised university , the words, recognised university or institute , shall be substituted; (b) in item (ii), for the words, maximum age limit for appointment by deputation , the words and brackets, maximum age limit for appointment by deputation (including short-term contract) , shall be substituted; (vi) the Note shall be omitted; (d) in column (13), for the existing entries, the following entries shall be substituted, namely:- Consultation with Union Public Service Commission necessary. ; (ii) in serial number 2, against the posts of Additional Director (Financial Transactions)/Joint Director (Financial Transactions), - (a) in column (1), the following Note shall be inserted, namely:- Note:- Only one post, i.e. Additional Director (Financial Transactions) or Joint Director (Financial Transactions) is to be operated at a time. ; (b) in column (4), for the existing entries, the following entries shall be substituted, namely:- (i) Level 13 (Rs. 1,23,100-2,15,900) in pay matrix for the post of Additional Director (Financial Transactions); (ii)Level 12 (Rs. 78,800-2,09,200) in pay matrix for the post of Joint Director (Financial Transactions). ; (c) in column (11), under the heading 'By deputation (including short-term contract)',- (i) for the words, autonomous and statutory bodies , the words, autonomous or statutory bodies , shall be substituted; (ii) under sub-heading For the post of Additional Director (Financial Transactions) , in clause (A), in item (ii), for the words, figures and letters, pay band-3, ₹ 15600-39100 with grade pay of ₹ 7600 , the words, figures, letters and brackets, level 12 in the pay matrix (Rs. 78,800-2,09,200) , shall be substituted; (iii) under sub-heading For the post of Joint Director (Financial Transactions) , in item (ii), for the words, figures and letters, pay band-3, ₹ 15600-39100 with grade pay of ₹ 6600 , the words, figures, letters and brackets, level 11 in the pay matrix (Rs. 67,700-2,08,700) , shall be substituted; (iv) under sub-heading Essential , after the words and brackets, Post Graduate Diploma in Management (Finance) , the words, from a recognised university or institute shall be inserted; (v) under sub-heading Desirable , - (a) in item (i), for the words, recognised university , the words, recognised university or institute , shall be substituted; (b) after the item (i), the following item shall be inserted, namely:- (ii) Should be conversant with tools and techniques of collection of evidence or recording of statement or collection, collation and presentation of best evidence to be used in prosecution proceedings. ; (vi) in Note.1, for the words, The maximum age limit for appointment by deputation , the words and brackets, The maximum age limit for appointment by deputation (including short-term contract) , shall be substituted; (vii) the Note.2 shall be omitted; (d) in column (13), for the existing entries, the following entries shall be substituted, namely:- Consultation with Union Public Service Commission necessary. .
