Securities Appellate Tribunal (Recruitment) Rules, 2001. - F. No. 5/30/CM/95-G.S.R. 673(E). - SEBIExtract MINISTRY OF FINANCE (Department of Economic Affairs) CAPITAL MARKET DIVISION NOTIFICATION New Delhi, the 17th September, 2001 SECURITIES APPELLATE TRIBUNAL (RECRUITMENT) RULES, 2001 G.S.R. 673(E).- In exercise of the powers conferred by sub-section (3) of section 15S of the Securities and Exchange Board of India Act, 1992 (15 of 1992) the Central Government, hereby makes the following rules to regulate the method of recruitment to various posts in the office of the Securities Appellate Tribunal, namely:- 1. Short title and commencement.- (1) These rules may be called the Securities Appellate Tribunal (Recruitment) Rules, 2001. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.- In these rules, unless the context otherwise requires.- (a) Act means the Securities and Exchange Board of India Act, 1992 (15 of 1992); (b) Appellate Tribunal means the Securities Appellate Tribunal established under sub-section (l) of section 15K of the Securities and Exchange Board of India Act. 1992 (15 of 1992); (c) Rules means the Securities Appellate Tribunal (Recruitment) Rules, 2001 (d) All other words and expressions used and not defined in these rules but defined in the Act shall have the meanings respectively assigned to them in the Act 3. Number of posts, classification and scale of pay.- The number of said posts, their classification and the scale or pay thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules 4 Methods of recruitment, age limit, qualification, etc.- The methods of recruitment, age limit, qualification, and other matters relating to the said posts shall be as specified in columns 5 to 14 of the said Schedule 5 Initial Constitution.- The employees holding the posts mentioned in the Schedule to these rules in the Securities Appellate Tribunal, Mumbai on the date of commencement of these rules shall be deemed to have been appointed at the Initial Constitution stage of the said posts, if so opted within 30 days of publication of these rules. The services rendered by them before the publication of these rules shall count for the purpose of probation period, qualifying service for promotion, confirmation and pension. 6 Disqualifications.- No persons. (a) who has entered into or contracted a marriage with a person having a spouse living, or (b) who, having a spouse living, has entered into or contracted a marriage with any other person, shall be eligible for appointment to the said posts Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule 7 Power to relax.- Where the Central government is of the opinion that it is expedient or necessary so to do, it may by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons 8 Saving.- Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Government of India from time to time in this regard.
