Rescinded vide Notification No. 21/97-Cus dated 1-3-1997 Specified Equipments Notification No. 6/86-Cus. Dated 2-1-1986 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts the goods specified in column (2) of the Table hereto annexed, when imported into India, from - (a) so much of that portion of the duty of customs leviable thereon under the First Schedule to the Customs Tariff Act, 1975 (51 of 1975); as is in excess of the amount calculated at the rate of 15 per cent ad valorem; and (b) the whole of the additional duty leviable thereon under section 3 of the said Customs Tariff Act, subject to the following conditions, namely :- (i) the importer, at the time of clearance produces a certificate from an officer not lower in rank than a Joint Secretary to the Government of India in the Department of Tourism to the effect that the goods imported are required for initial setting up of a hotel or for substantial expansion of a hotel, duly approved by that Department ; and (ii) the importer produces evidence to the satisfaction of the Assistant Collector of Customs within two years from the date of importation or within such extended period as the Assistant Collector of Customs may allow, to the effect that the goods have been actually used for the purpose specified in (i) above.
