Specified equipments imported by a correspondent of foreign news agency etc. - 355/85 - Customs -TariffExtract Specified equipments imported by a correspondent of foreign news agency etc. Notification No. 355/85-Cus. Dated 6-12-1985 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts the goods specified in column (2) of the Table hereto annexed, when imported into India, from (a) so much of that portion of the duty of customs leviable thereon under the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), as is in excess of the amount calculated at the rate of 40 per cent ad valorem; and (b) the whole of the additional duty leviable thereon under section 3 of the said Customs Tariff Act, subject to the following conditions, namely : (i) the importer produces a certificate from an officer not lower in rank than a Deputy Principal Information officer in the Press Information Bureau of the Government of India in the Ministry of Information and Broadcasting to the effect that (a) the importer is an accredited correspondent of a foreign broadcasting and television organisation or, as the case may be, of a foreign news agency or a foreign newspaper; (b) the goods imported have been supplied to the importer free of cost by the said organisation or, as the case may be, the news agency or the newspaper, and the ownership of such goods continues to be with the said organisation, or as the case may be, news agency or newspaper; (c) the goods imported are solely for the importer's official work; (d) not more than one unit each of the said goods is being imported under this notification by the importer; (e) the importer has not availed of the exemption under this notification on any previous occasion in respect of the goods being imported; and (f) the grant of the exemption under this notification is recommended; (ii) the importer gives an undertaking to the Assistant Collector of Customs at the time and place of importation to the effect that the said goods shall remain in his possession, control and use and shall not be parted with, sold or hired out to anyone else without the prior permission of the Government of India in the Ministry of Finance (Department of Revenue). The following goods imported by a correspondent of a foreign broadcasting and television organisation, namely : (i) 3/4" Betacam camera and recording pack; (ii) Betacam playback unit and monitor; (iii) Editing pack; (iv) Pair of studio editing machines; (v) Mixing equipment; (vi) Noise reduction equipment. 2. The following goods imported by a correspondent of a foreign news agency or a foreign newspaper, namely : (i) Word processor; (ii) Constant power pack. 2. This notification shall be in force upto and inclusive of the 31st day of December, 1990.
