..... confiscated the seven pieces of primary gold weighing 1,308.300 gms. valuing at Rs. 3,00,909/- which is alleged to have been seized from the secret organ of the appellant Madhu Agarwal. The personal penalty of Rs. 10,000/- was imposed on each of the appellants, both under the Customs Act and Gold (Control) Act. 2. The brief facts of the case are that on the basis of information, the Customs Officers of Naxalbari intercepted the appellant Hemant Agarwal and his wife Madhu Agarwal at L.R.P. He pointed out that there is no reason as to why the Officers should implant these seven pcs. of gold on the appellant. He prayed for the dismissal of the appeals. 5. Therefore, it is highly doubtful whether the seven gold pieces were recovered from the private organ of Madhu Agarwal. On the contrary, the evidence indicates that this story is not a true one. Accordingly, we hold that the prosecution has not proved that this gold pieces were recovered from the possession of appellant Madhu Agarwal. 8. But the second question for our consideration is whether the statements given by Madhu Agarwal as well as Hemant Kumar Agarwal were true and voluntary.
