Though the importer had claimed to be a E.O.U., but it does not have necessary infrastructure to manufacture the final product out of the imported material sought to be cleared and the D.R.I. investigation revealed that the importer clandestinely sold the duty free imported raw materials cleared earlier. Therefore, the Commissioner concluded that it could not be ruled out that the same intention was not present in this case also, and accordingly, held that it was only the constant vigilant watch over the import of consignments which resulted in the manufacturers having opted for domestic clearance on payment of duty and therefore, held that the present imports were meant for disposal in the domestic market without payment of duty.
