The Hon ble High Court of Andhra Pradesh after considering at length the issues involved, held that in the absence of a specific statutory definition of cash management or even asset management , the question of its wider interpretation either by seeking to include or exclude any other transactions or business does not arise and is not permissible and thereby quashed the Master Circular imposing Service tax on Chit fund business. Later on, on the similar issue, divergent judgment was given by the Hon ble High Court of Kerala upholding validity of Service tax on Chit fund business in the case of All Kerala Associatio .....

..... Reply By Saimukundhan G as = Dear Mr. Bimal Jain If the SC had dismissed the SLP filed by the Revenue in 2013 itself (for Delhi Chitfunds Associations), and still the Government went ahead with an amendment to entry 8 of the Abatement Notification (primarily rephrasing the conditions for abatement on Chitfund Business) w.e.f. 11th July 2014, instead of deleting it, it only implies that the Government hopes to collect taxes on the Chit Fund business going forward. Any clarification on this point would be highly appreciated. On a personal note, I believe the SC has erred in not holding the services of Foreman taxable under ST law.
