Amendments are to amend clause (j) and clause (m) of sub-section (2) in the present section. These amendments will take effect retrospectively from 1st April, 2019 and will, accordingly, apply in relation to the assessment year 2019-2020 and subsequent assessment years. The section was inserted w.e.f. 01.04.2016 and was earlier amended in some respects w.e.f. 01.04.2017 including one amendment which was made w.e.f.r. 01.04.2016 vide the FA 2017 . As per Explanations given in the Memorandum it is for relaxation in conditions of special taxation regime for offshore funds. As per speech of honorable FM also two conditions, relating to the remuneration of fund manager and the time limit for building up of corpus, are proposed to be rationalised so as to facilitate setting up of fund management activity in India with respect to such offshore funds. ..... (Author could not find any logic for fixing date 01.04.2019. Therefore, Honorable FM will do well to revise the effective date to make the amendment fully meaningful and to avoid un-necessary litigation. Otherwise litigation is likely to take place and Courts are likely to apply the provision w.r..e.f. 01.04.2017 the initial date. Present section is reproduced below with highlights added by author. Further, an eligible investment fund shall not be said to be resident in India merely because the eligible fund manager undertaking fund management activities on its behalf is located in India.
