..... ision of the Hon ble Allahabad High Court in the case of Atma Singh Vs. State of Punjab reported in 2024(3) AICLR 714 Allahabad. Upon considering the facts of the case and the provisions laid down in Section 94 and 96 of the Insolvency And Bankruptcy Code, 2016, this court is of the view that even if an accused does not appear before the learned trial court when such order passed by the learned tribunal is within the knowledge of the complainant, such fact should be brought to the notice of the learned Magistrate.
