Imported betel nuts rightly classified, but penalties reduced for declared value mismatch with DGFT minimum price.

The CESTAT determined that imported betel nuts were correctly classified under CTH 0802 8030. Although the minimum import price set by the DGFT could not be used to reject the declared transaction value, confiscation and penalties were deemed appropriate. The redemption fine was reduced to 5% of the DGFT value, amounting to Rs.10,95,000/-, and the penalty under section 112(a) was lowered to Rs.5,00,000/-. The goods were allowed to be re-exported with the reduced redemption fine, and the appeal was partially allowed. .....
