We have considered the submissions of both the sides. The undisputed facts are that the bailing press was installed in the factory premises of the Appellants and was damaged due to fire. The Department has demanded Central Excise duty treating fire being avoidable accident, relying upon the Official Surveyor's Report. According to the said Report, the cause of the fire could not be ascertained.
