2005 (5) TMI 9 - AT - Central Excise


The Appellate Tribunal CESTAT, Mumbai ruled on the classification of medicaments assessed as patent and proprietary based on a Russian language label Zymicin. The Revenue's appeal was dismissed as Zymicin was accepted as a brand name for classification as patent and proprietary medicine, even with a label in Russian. The goods must be classified as they emerge and pay duty accordingly. The order of CCE (A) was upheld, and the Revenue's appeal was required to be dismissed.
