Analysis:
1. The Appellate Tribunal CESTAT, CHENNAI addressed the issue of denial of the benefit of exemption Notification No. 61/88 dated 1-3-1988 to the assessee. The Tribunal directed the original authority to reevaluate whether the assessee was eligible for exemption under the Notification, ensuring a fair opportunity for the assessee to present their case. Notably, the Tribunal highlighted that the assessee now possessed copies of the Chemical Examiner's test reports, emphasizing the importance of due process and fair consideration in reaching a decision.
