2009 (8) TMI 871 - AT - Customs

In the judgement by the Appellate Tribunal CESTAT, CHENNAI, the case involved M/s. Global Exports obtaining two Advance Licences for import of upholstery fabrics without payment of Customs duty against export of seat covers. It was found that bank guarantees were fake, leading to a penalty being imposed on the CHA for submission of fake bank guarantees and acting as an agent of a fictitious firm. The appellant, a CHA, argued that they had no knowledge of the fake bank guarantees and that their responsibility ceased upon handing over the goods to transporters. The Tribunal found no evidence of commission or omission by the CHA, leading to the penalty being set aside and the appeal being allowed. The order was pronounced on 13-8-2009.
