Demand (Customs) Revenue contended that assessee-respondent was not entitled to avail any benefit of DEPB on the ground of DEPB purchased by the assessee from open market has be cancelled by the DGFT - the decision in the case of COMMISSIONER OF CUSTOMS Versus LEADER VALVES LTD. 2007 (3) TMI 166 - PUNJAB & HARYANA HIGH COURT , contested, where it was held that assessee entitled to availed the benefit of DEPB for the reason that it is third person liability not of assessee - Held that - the decision in the above case upheld - SLP dismissed both on the ground of delay as also on merit.
