The assessee argued that the income qualified for exemption u/s.22(2) based on a precedent. The Tribunal found the facts similar to the precedent and deleted the addition of &8377; 1,68,000/-, allowing the appeal filed by the assessee. Conclusion: The Appellate Tribunal ITAT Mumbai allowed the appeal filed by the assessee, deleting the additions of notional income under the head "Income from house property" for both the Thane and Mahavir Market properties for the assessment year 2006-07.
