The appeal concerns the interpretation of section 38-B of the U.P. Imposition of Ceiling on Land Holdings Act, 1960. A previous judgment held no land of the appellant could be declared surplus, but a subsequent order by the Prescribed Authority did so. The High Court held the previous finding operated as res judicata based on a previous case. The Supreme Court directed the appellant's counsel to provide the judgment from the previous case and information on the second proceeding within four weeks. Case to be heard further after four weeks.
