2010 (9) TMI 311 - AT - Central ExciseAppeal service notice of hearing - records nowhere disclose the respondents having been served with a notice - duty of the Court Master to ensure that the file contains necessary recording by the Registry that the notice of the hearing has been served upon the parties - Assistant Registrar should ensure henceforth that such recording is made in each and every file before the file being placed before the Bench for hearing the matter - responsibility of the Court Master to verify the same direction to issue notice for hearing
The Appellate Tribunal CESTAT, Bangalore emphasized the importance of ensuring that parties are served with a notice of the hearing before a matter is listed. The court directed the Assistant Registrar and Court Master to make a recording in each file to confirm notice has been served. The respondents in the case were issued a notice for a hearing on 16-11-2010.
