2011 (4) TMI 26 - HC - CustomsExemption from Additional Duty of Customs - The respondents are directed to release the goods concerned in respect of the Bills of Entry subject to the condition that the petitioner furnishes a bank guarantee for the entire value of Additional Duty of Customs (CVD) to the satisfaction of the second respondent which shall be kept alive till the adjudication process is completed - as and when the bank guarantee is furnished the respondents shall release the goods forthwith - Hence the writ petition is ordered accordingly.
The High Court of Madras directed the respondents to release goods upon furnishing a bank guarantee for Additional Duty of Customs (CVD) in a case involving Bill of Entry No.3274284 and Bill of Entry No.3325340. The exemption from CVD under Notification No.30/2004-CE was not granted. The petitioner was instructed to provide the bank guarantee for the entire CVD amount until the adjudication process is completed.
