Substantial question of law - Held that - In the light of the submissions of Mr. Mistry, learned senior counsel appearing for the assessee which are substantiated by the record, Question No.(2) at page 4 of the appeal paper-book stated to be a substantial question of law, arising out of the Tribunal s order dated 26th March, 2014, does not arise for Assessment Year 2002-2003. In the result, that could not have been proposed as a substantial question of law by the Revenue in this appeal. Once we come to this conclusion then this appeal need not be entertained. It is dismissed.

Summary

The Bombay High Court dismissed the appeal as Question No. 2 for Assessment Year 2002-2003 was not a substantial question of law. The appeal was not entertained, and there was no order as to costs. Other three questions were answered in a separate order.
