The judgment of the Bombay High Court in 1908 (7) TMI 1 stated that document Ex. 25 is a mortgage deed, following a Full Bench decision in Tukaram v. Ramchand. The court found close resemblance between the two documents and confirmed the decree under appeal, dismissing the appeal with costs.
