2018 (3) TMI 1687 - SCH - Indian LawsMaintainability of petition - Article 32 of the Constitution - Held that - The petitioners have been issued summons with a direction to appear before the Trial Court today i.e. 14.03.2018 - The petitioners shall be at liberty to file applications under Section 88 of the Code of Criminal Procedure, 1973 and/or the bail application as advised - petition disposed off.
The Supreme Court of India declined to entertain the petition on merits under Article 32 of the Constitution. Petitioners were directed to approach the Trial Court first. They were given liberty to appear before the Trial Court the next day. Petitioners were allowed to file applications under Section 88 of the Code of Criminal Procedure and bail applications, with a 30-day protection from arrest to approach the High Court or a higher forum. The writ petition was disposed of, and any pending applications were also disposed of accordingly.
