The High Court of Madras ruled that the omission to levy penal interest does not constitute a waiver. The Commissioner's order under section 263 of the Income-tax Act was justified in law. The assessee's appeal was dismissed, and there were no costs awarded. The Income-tax Officer can still consider relief under rule 40.
