On this ground alone, this writ petition is allowed. The detenu be released immediately.
The Supreme Court allowed a writ petition challenging a detention order under the COFEPOSA Act, 1974, due to lack of proximate link between events leading to the order and its timing. The petitioner was alleged to be part of a smuggling ring involving seized gold worth around Rs. 204.60 Crores. The detenu was ordered to be released immediately.
