2011 (9) TMI 1213 - SC - Indian Laws

Issues involved:
The judgment involves the dismissal of a writ petition by the High Court of Gujarat, seeking registration of a private complaint as a First Information Report (FIR) and further investigation by an independent agency, following events in Gujarat between February 2002 and May 2002.

Details of the Judgment:

1. The appellant, who lost her husband in the events of February 2002, sought registration of another FIR against certain persons for various offenses. The High Court dismissed the writ petition, stating that the appellant could approach the investigating agency or the court for further investigation under Section 173 of the Code of Criminal Procedure.

2. An Amicus Curiae was appointed to assist the Court, and a Special Investigation Team (SIT) was directed to look into the appellant's complaint. The SIT recommended further investigation against certain police officials and a Minister in the State Cabinet.

3. The SIT conducted further investigation and submitted a report, which was examined by the Amicus Curiae. The Amicus Curiae submitted a final report, leading to a determination on the future course of action.

4. The Court directed the Chairman of the SIT to forward the final report and all collected material to the Court empowered to take cognizance of the offense alleged, as required under Section 173 of the Code.

5. The Court emphasized that once the investigation is completed, the final report must be forwarded to the appropriate Court for further action, as per the legal procedure. The Court clarified that it would not continue to monitor the case further after the submission of the final report.

6. The Court directed the State of Gujarat to reimburse the expenses incurred by the Amicus Curiae and appreciated their assistance in the case. The Court concluded that the monitoring of the case should come to an end, disposing of the appeal accordingly.
