1924 (3) TMI 6 - HC - Indian Laws

The plaintiff, defendant, and Subba Konar were sureties for Muthukrishna Naidu. The defendant obtained a hypothecation bond from the debtor, agreeing to discharge the promissory-notes. The plaintiff paid Rs. 615 in execution of the decree. The plaintiff's suit to recover the money was initially decreed by the District Munsif but dismissed by the District Judge. The defendant, having received a counter-security, is liable to contribute to the plaintiff and co-sureties. The case is remanded for further evidence.
