2017 (4) TMI 779 - SCH - Indian LawsCharges under Section 138 r.w.s. 141 of the Negotiable Instruments Act - Held that - High Court in these criminal revisions, had initially passed the order for suspending the sentence. However, by the impugned order, the said order of suspension of sentence has been withdrawn. It is a matter of record that the appellants have so far paid ₹ 80 lakhs. In these circumstances, we are of the opinion that the sentence awarded by the Courts below need to be suspended till the decision of the revision petitions. Ordered accordingly. The impugned order dated 16.12.2015 withdrawing the order of suspension of the sentence is hereby set aside and the appeals are allowed in the aforesaid terms.
The Supreme Court granted leave and suspended the sentence of appellants convicted under Section 138 read with Section 141 of the Negotiable Instruments Act, 1882. The High Court's order withdrawing the suspension was set aside, and the appeals were allowed. The appellants have paid &8377; 80 lakhs. The High Court was directed to expedite the case hearing.
