2008 (8) TMI 352 - HC - CustomsProperty attached by the Custom authority in January, 2004 for recovery of its dues. A co-operative bank had initiated recovery proceedings against the owner of the said property for recovery of its dues and after the recovery certificate was granted in favour of the creditor by the recovery officer, the property was attached and it was sold on 15-4-2004 to the petitioner. Therefore, the property obviously is purchased by the petitioner subject to the prior attachment of the Custom authority, and therefore, we do not find any fault in the order impugned in the petition
The Bombay High Court upheld the order regarding a property purchased subject to a prior attachment by the Custom authority in a recovery case. The property was sold to the petitioner in 2004. The court found no fault in the impugned order and disposed of the petition.
