2018 (9) TMI 846 - SC - Indian Laws

Issues:
Transfer of multiple pending cases to the Supreme Court for final disposal.

Analysis:
The Supreme Court, presided over by Mr. Fali Nariman and Ms. Indu Malhotra, JJ., allowed the transfer of various cases pending before different High Courts to the Supreme Court. The Transfer Petitions sought the transfer of cases such as W.P. (C) No. 20672-20676/2018, Special Civil Application No. 12492 of 2018, Civil Misc. Writ Petition No. 18170 of 2018, Civil Misc. Writ Petition No. 23181 of 2018, Civil Misc. Writ Petition No. 23183 of 2018, W.P. No. 16095 of 2018, Writ Petition (C) No. 7221/2018, and Writ Petition (C) No. 6463/2018 to the Supreme Court. The Court directed the immediate transfer of records of these cases without delay. It was further ordered that the status quo as of the current date should be maintained until further notice.

In another matter, Writ Petition (C) No. 1086/2018, the Court also issued notice and ordered the maintenance of status quo until further instructions. All these petitions were listed for final disposal on Wednesday, the 14th of November, 2018. The Supreme Court's decision to consolidate these cases for final disposal demonstrates the exercise of its jurisdiction to ensure uniformity and consistency in the interpretation and application of the law across different jurisdictions. This transfer of cases to the Supreme Court will streamline the adjudication process and avoid conflicting decisions on similar legal issues.
