Summary

The consignment of alloy steel is liable to duty under Tariff Item No. 73.15(1), not under Tariff Item No. 73.15(2). The issue of auxiliary duty is left open for fresh adjudication. The relevant date for duty assessment is the date of clearance from the warehouse. The Assistant Collector of Customs will pass a fresh adjudication order within four weeks. Rule made absolute with no costs. Bank guarantee to be kept operative for four weeks from the date of adjudication order.
