1995 (8) TMI 68 - HC - Customs

The High Court of Delhi granted bail to C.B. Sharma, a non-resident Indian, accused under Sections 132 and 135 of the Custom Act. Nine watches with alleged diamond studs were found in his possession upon arrival from Hongkong. Sharma claimed they had artificial diamonds and provided purchase receipts. Customs authorities had not assessed their value after eight months. Sharma was also detained under COFEPOSA, but the Advisory Board did not approve the detention. The court ordered Sharma's release on bail upon furnishing a personal bond of Rs. 25,000 with two sureties, with conditions to cooperate with the investigation and inform Customs about his foreign trips.
