Delay in pre deposit- There was a delay in making pre-deposit of ₹ 45,00,000/- in the pending matter before the Customs, Excise and Service Tax Appellate Tribunal, Mumbai. Held that- appeal dismissed for non-compliance of pre deposit, as the pre-deposit made after lapse of 16 months from due date and after appeal dismissed by Tribunal. Thus the interest @ 9% of the amount of pre-deposit directed to be paid for the period of delay. CESTAT directed to expeditiously hear and dispose the appeal.

Summary
