Section 74 - Manner of reckoning fifth, eighth and tenth days in sections 72 and 73. - Companies Act, 1956Extract Manner of reckoning fifth, eighth and tenth days in sections 72 and 73. 74. In reckoning for the purposes of sections 72 and 73, the fifth day, [1] [or the eighth day], after another day, any intervening day which is a public holiday under the Negotiable Instruments Act, 1881 (26 of 1881), shall be disregarded, and if the fifth, [2] [or eighth day] (as so reckoned) is itself such a public holiday, there shall for the said purposes be substituted the first day thereafter which is not such a holiday.] ---------------------------------------- Notes:- [1] Substituted by the Companies (Amendment) Act, 1988, section 11, w.e.f. 15-6-1988 for the words "the eighth day, or the tenth day".
