Section 400 - Notice to be given to Central Government of applications under sections 397 and 398. - Companies Act, 1956Extract Notice to be given to Central Government of applications under sections 397 and 398 [1] . 400. The [2] [Tribunal] shall give notice of every application made to it under section 397 or 398 to the Central Government, and shall take into consideration the representations, if any, made to it by that Government before passing final a order under that section. [3] ------------------------------- Notes:- [1] Powers delegated to Regional Directors vide Notification No. GSR 288(E), dated 31-5-1991. [2] Substituted for "Company Law Board" by the Companies (Second Amendment) Act, 2002. [3] Fees prescribed is Rs. 5000, w.e.f. 1-4-2000. On notification of the commencement of the amendment, power will be transferred to the National Company Law Tribunal.
