Section 405 - Addition of respondents to application under section 397 or 398. - Companies Act, 1956Extract Addition of respondents to application under section 397 or 398 [1] . 405. If the managing director or any other director [2] [* * *] or the manager, of a company, or any other person, who has not been impleaded as a respondent to any application under section 397 or 398 applies to be added as a respondent thereto, the [3] [Tribunal] shall, if it is satisfied that there is sufficient cause for doing so, direct that he may be added as a respondent accordingly. ------------------------------------------- Notes:- [1] Fees prescribed is Rs. 5000, w.e.f. 1-4-2000. On notification of the commencement of the amendment, power will be transferred to the National Company Law Tribunal. [2] Omitted by the Companies (Amendment) Act, 2000 as provisions relating to the managing agents, secretaries and treasures had become redundant after abolition of system by Act 17 of 1969. [3] Substituted for "Company Law Board" by the Companies (Second Amendment) Act, 2002, w.e.f. a date yet to be notified. Earlier the quoted words were substituted for Court by the Companies (Amendment) Act, 1988, w.e.f. 31-5-1991.
