34. Transition Provision Notwithstanding the relevant date, the provisions of sub-section (2) of section 6 , sub-section (4) of section 6 , and section 6A of the Act shall apply to an acquisition of control, shares, voting rights or assets of an enterprise, merger or amalgamation which comes into effect, wholly or partly, on or after the date on which these regulations come into force: Provided that such acquisition, merger or amalgamation otherwise satisfies the provisions of section 5 of the Act and is not exempt under the provisions of Act or rules made thereunder as applicable on the date on which these regulations come into force, if the same previously did not require notice to the Commission. Provided further that the provisions of section 43A of the Act shall not apply in relation to any part of such acquisition, merger or amalgamation which has come into effect before these regulations come into force, if the same previously did not require notice to the Commission.
