It is an excellent idea to trademark a brand, emblem, or name. The trademark brought into service must be unique to distinguish it from other similar products. What does a trademark mean?

A trademark is a kind of intellectual property that mainly consists of recognizable symbols, designs, and expressions. It helps to recognize a product or service from a specific source apart from those from others.

Characteristics of the Perfect Trademark:

A strong trademark should indicate a high quality of sound and visual appeal and suggest the quality of the product. In addition to this, a perfect trademark should be designed so that it can be distinguished, out-stands from the other trademarks in the same category, and allows for registration and protection. The following are the qualities of a perfect trademark that should be considered before trademark registration:.

  • A trademark must be a mark that includes a heading. Brand, signature, label, signature, design, word, letter, numerical, or packaging of other combinations of the above-mentioned characteristics.
  • It must be easy to speak and spell. A strong trademark allows the general public to speak and spell easily.

  • A strong trademark must not be prevented under the Trademark Act's prohibited classes of trademarks.

In India, trademark registration provides rights to use it on products or services. The registration process mainly consists of submitting an application to the Ministry of Commerce and Industries, controller general of designs, trademarks, and patents. Obtaining legal advice from a trademark attorney guarantees the trademark's compliance with Indian trademark laws and speeds up the procedure.
