2014 (9) TMI 232 - SCH - CustomsConfiscation of goods - re-validation of licence - Held that - it is agreed that the respondent would not seek release of the subject licences till the said petition is finally disposed of by the High Court. It is however, clarified that if the issue before the High Court is decided in favour of the respondent, it will be open to them to seek revalidation of the licences, which may have expired in the meanwhile. The prayer for revalidation shall be considered by the concerned authority as per the prescribed procedure.
The Supreme Court of India disposed of the case by requesting the High Court to make a final decision on Special Civil Application No. 3031 of 2011 promptly. The respondent agreed not to seek release of licenses until the High Court's decision, with the option to request revalidation if favorable. The Supreme Court did not express any opinion on the case's merits, leaving the decision to the High Court.
