2022 (8) TMI 974 - HC - GST

Issues: Improving the system under the Central Goods and Services Tax Act, 2017 and the Delhi Goods and Services Tax Act, 2017

Analysis:
The High Court, comprising Hon'ble Mr. Justice Rajiv Shakdher and Hon'ble Ms. Justice Tara Vitasta Ganju, noted the submission of status reports by respondents no. 2, 3, 5, 6, and 7 pursuant to previous court orders. The counsels for the respondents confirmed providing copies of the reports to the petitioners' counsel. These reports are to be filed officially before the next hearing date.

The petitioners' counsel, Mr. Puneet Agarwal, was directed to formulate suggestions for enhancing the system under the Central Goods and Services Tax Act, 2017 and the Delhi Goods and Services Tax Act, 2017. These suggestions, aimed at addressing operational challenges, will be shared with the respondents' counsels for evaluation of their viability and potential incorporation.

Additionally, the court emphasized the involvement of Infosys, responsible for the GSTN portal's installation and maintenance, in this process. A representative from Infosys, Mr. Bagaria, along with the technical team from Tech Mahindra, represented by Ms. Ambika Mathur, are required to participate in the discussions to rectify existing system glitches. Both Infosys and Tech Mahindra were urged to actively engage in the forthcoming meetings to contribute to system improvement efforts.

Consequently, the court scheduled the next hearing for 26.09.2022 to monitor the progress and further developments in enhancing the efficiency of the system under the mentioned tax acts.
