2025 (1) TMI 751 - HC - CustomsChallenge to revision of a Tariff Rate Quota (TRQ) under the Comprehensive Economic Partnership Agreement (CEPA) between India and UAE - HELD THAT - This Court, after careful consideration of the contentions, has issued directions vide order dated 05th December, 2024. Accordingly, it is directed that the order dated 05th December, 2024 passed in W.P.(C) 16809/2024 and other connected matters 2024 (12) TMI 544 - DELHI HIGH COURT , shall apply mutatis mutandis in the present case as well. The petition is disposed off.
In the case before the Delhi High Court, presided over by Hon'ble Mr. Justice Sanjeev Narula, the petitioner, engaged in importing gold bullion for manufacturing gold ornaments, challenges the revision of a Tariff Rate Quota ("TRQ") under the Comprehensive Economic Partnership Agreement ("CEPA") between India and UAE. This revision, based on a meeting held on 8th November 2024, is contested in the present petition.
The court references a previous order from 5th December 2024 in W.P.(C) 16809/2024, which dealt with similar issues, and applies its directions "mutatis mutandis" to the current case. Additionally, the petitioner seeks a mandamus for the Director General of Foreign Trade (DGFT) to approve an amendment to the TRQ license, an application pending since 23rd October 2024, with a reminder sent on 19th November 2024. The court directs the DGFT to decide on the petitioner's application for amendment of the TRQ license within four weeks. The petition is disposed of with these directions, along with any pending applications.
