A report has to be submitted to the Board by the 10th of every month of all cases where appeals have been field to the High Court. - Income Tax - 1957/1998Extract INSTRUCTION NO. 1957/1998 Dated: December 22, 1998 Sections 260A has been introduced w.e.f. 1.10.98 providing for direct appeal to the High Court. It has, therefore, been decided to create a High Court Cell in each Chief Commissionerate directly under the administrative control of the CCIT to provide coordinated action in filing of appeals to the High Court. The manpower and the resources available in the field formations will be utilised to constitute the Cell. 2. The High Court Cell may be structured around the existing judicial set-up functioning in each charge. There should be at least three or four Inspectors working under the Addl. CIT/JCIT for coordinating between field officers and Standing counsels and for maintaining statistics such as casewise performance of Standing Counsels, payment of fees, etc. The Addl. CIT/DCIT (Judicial) should be provided with infrastructural facilities, viz. photocopier, telephone with STD/Fax, computers and access to legal library. One or two full time Stenographers will be provided to the Cell. Staff car should be made available to the officers of the Cell as and when required. 3. The mechanism and the modalities of the functioning of the High Court Cell will be suitably decided by the respective CCITs taking into account the requirements of their region/charge. 4. A report has to be submitted to the Board by the 10th of every month including list of all cases where appeals have been field to the High Court along with facts of each case and the tax effect.
