CUSTOMS - HIGH SEAS SALE BY CANALISING AGENCIES (PUBLIC GOVT.UNDERTAKINGS) LIKE MMTC AND STC. [BOMBAY COLLECTORATE CUSTOMS PUBLIC NOTICE NO. 07-PN DT. 12.1.1995] - Customs - Public Notice: 07/95-CUS-BOMBAYExtract Public Notice: 07/95-CUS-BOMBAY Dated On : 12-01-1995 Attention of the trade is invited to this Custom House P. No. No 226 dated 16.11.1983 on the above subject. The said Public Notice was amended on 7.4.1984 top the effect that in case of High Seas Sales of canalising agencies, a High Sea letter issued by such agencies may be accepted as sufficient evidence. It has been represented by some trade interests that for some time, the Import Department has been referring the cases of High Seas Sales including those by the canalising agencies (like MMTC and STC etc.) to the Assessing Groups for their 'no objection' before allowing amendment to the IGM for the purpose of noting of Bills of Entry. It has now been decided that, in the case of High Seas Sales by canalising Agencies (Public Sector Undertakings Like MMTC and STC etc.) amendment application from revenue/licence angle shall be decided by Import Department itself without making any reference to other Sections of the Customs House in general course, provided that the canalising agencies (Public Sector Undertakings) like MMTC and STC etc. under signature of authorised signatories give a declaration addressed to the Assistant Collector of Customs, Import Department to the effect that : 1. No less charge etc. is pending in any section of the Custom House. 2. Item under importation is not appearing in the negative list of the Import/Export Policy in force. 3. The original overseas suppliers 'invoices furnished to the department is genuine. 4. True commission charged from High Seas Buyer has been declared in the contract of Rs. 100/- Stamp paper between High Seas Seller and Buyer. The application should be accompanies by a certified copy of the High Seas Sales contract on Rs. 100/- stamp paper or on the letterhead of the canalising Agency (Public Sector Undertakings) signed by both the parties. This is to add that the above mentioned facility is being granted on the assumption and hope that no undue advantage of the same will be taken by the trade. The Procedure will, therefore, be under watch, and if adverse instances come to notice, the facility could be withdrawn.
