No. S/26-Misc- 686/2006 EPCG JCH Date: 02.01.2007 FACILITY NOTICE NO. 01/ 2007 (Referred / amended vide P.N.No. 25/2008, 79/2009) Subject: Execution of Bank Guarantee at 15% of duty saved amount by Other Manufacturer Exporters under EPCG scheme reg. Attention of all Importers/Exporters / CHA s and EPCG licence holders is invited to the subject of execution of BG at 15% of duty saved amount by Manufacturer Exporters with the customs for fulfillment of export obligation under EPCG scheme. CBEC Circular No. 58/2004-Cus. dated 21.10.2004 , prescribes norms for exemption from execution of Bank Guarantee under EPCG scheme with the customs towards fulfillment of export obligation in lieu of imports under this scheme. 2. Para 3.1 (f) of CBEC Circular No. 58/2004-Cus. dated 21.10.2004 prescribed BG at 25% of duty saved amount as the quantum of Bank Guarantee to be executed with the customs for other Manufacturer Exporters (which was subsequently reduced to BG at 15% of the duty saved amount vide CBEC Circular No. 30/2005-Cus. dated 12.07.2005 ). 3. In this regard, any one of the following documents would be required to be submitted by applicants claiming to fall under the category of other Manufacturer Exporter in terms of Para 3.1 (f), to be eligible for execution of BG at 15% of duty saved amount with EPCG section, JNCH : (i) Permanent Central Excise Registration Certificate duly certified by Jurisdictional Superintendent of Central Excise with Pan Card. (ii) Permanent S.S.I. Registration Certificate issued by District Industries Centre with Pan Card. (Mere Acknowledgement is not sufficient) (iii) Permanent Registration Certificate issued by Secretariat for Industrial Assistance, New Delhi with Pan Card.. (Mere Acknowledgement is not sufficient) (iv) Any other Registration Certificate as a proof of manufacturer exporter status along with previous Export Performance certified by Chartered Accountant / any Export Promotion Council with Pan Card. 4.
