No. S/6-Misc-716/2013-14 ACC (X) Shed Date: 06.12.2013 PUBLIC NOTICE NO. 30/2013 SUB: Export of finished Leather, Wet Blue Leather and EI Tanned Leather- reg. Attention of trade and other stakeholders is invited to Public Notice No. 24 (RE-2013)/ 2009-14 dated 05.09.2013 issued by DGFT permitting export of finished leather, wet blue and EI Tanned through Airports subject to drawal of samples by Customs, wherever so required, for certification by Central Leather Research Institute (CLRI) or such other labs as notified from time to time, as per finished leather norms notified vide Public Notice No. 21/2009-14 dated 01.12.2009 Currently no CLRI office is located at Air Cargo Complex, Mumbai. Till the time CLRI deputes the officials at Air Cargo Complex, the following procedure for examination of consignments declared as finished leather shall be followed at Air Cargo Complex, Mumbai- PROCEDURE OF ASSESSMENT EXAMINATION- (i) The product shall conform to finished leather norms prescribed under DGFT public notice 21/2009-14 dated 01.12.2009, failing which it will be subjected to export cess as defined in SI.26 of schedule 2 of Customs Tariff Act, 1974 as amended. (ii) Customs officers posted in export shed shall draw the sample, wherever required, and forward the same to Director, Central Leather Research Institute (CLRI) Chennai, Sardar Patel Road Adyar, Chennai 600020 and such other laboratories as notified from time to time for testing and, till receipt of the test report, such shipping bills shall be provisionally assessed. (iii) The exporters on filing shipping bill shall execute a provisional bond as per Customs (Provisional Duty Assessment) Regulations, 2011. The Exporters registered with Council for Leather Export (CLE) may execute a simple bond for this purpose. For other exporters, additional security equal to 20 % of export duty leviable will be required. (iv) The Exporter shall pay applicable testing charges and the same would be forwarded alongwith sample so drawn. (v) After drawal of samples of such consignments, the custom officer shall endorse with their stamp in test memo in triplicate as per Annexure attached. The details of shipping bill shall also be written at the back of each sample and endorsed by Customs. (vi) The representative sample along with first test memo shall be forwarded to Director, CLRI, Chennai by courier/speed post. Second copy will be handed over to exporter/ representative. (vii) Third copy of the test memo is to be placed in the docket retained in Export Shed. A register will be maintained by Export Shed, indicating the details of sample drawn, under supervision of DC/AC of concerned Export Shed. (viii) After due examination, the examining officer shall make following entry in the departmental comments this S/B assessed provisionally subject to outcome of test result from CLRI on sample no. .. The provisional bond number is submitted to DC/AC Export Shed, in this regard . (ix) Test report from CLRI, Chennai office will be received in the office of Assistant Commissioner of Customs (Export Shed) from where the samples have been drawn. (x) If the test report confirms it to be finished Leather as per declaration of the exporter, the shipping bill will be finalized and the bond will be closed. Otherwise, the goods would be subjected to Export Duty and further necessary action will be taken in accordance with law.
