Matter regarding issue of Port Clearance. - Customs - 23/2006Extract GOVT. OF INDIA OFFICE OF THE COMMISSIONER OF CUSTOMS CUSTOM HOUSE, KANDLA F.No. S/01-01/2006-APPG (G) Public Notice No. 23/2006 Date : 21.03.2006 Subject Matter regarding issue of Port Clearance. Attention of all Importers, Exporters, Custom House Agents, Shipping Agents and Members of the Trade are invited to Section -42 of Customs Act, 1962 which stipulates that no conveyance which has brought any imported goods or has loaded any export goods shall depart from the Customs Station until a written order to that effect has been given by the proper office. The proper officer for granting the written order under Section 42 of Customs Act, 1962 shall be the Assistant Commissioner (Export) on the normal working days. For Saturday, Sunday and Holiday the duties of the Assistant Commissioner would be earmarked on rotation basis by the Additional Commissioner (Export). Application for seeking Port Clearance shall be made to the designated officer with the following documents. (I) N.O.C. from the Harbour Master, Kandla Port Trust. (II) N.O.C. from Police Department. (III) List of passengers verified from the arrival report. (IV) Income Tax Certificate. (V) Light dues receipt. (VI) Duty payment particulars on provision/Bunker store in case of reversion of vessel, converted from foreign run to costal run. (VII) General declaration Viz. EGM., P.C. of last port etc. In any exceptional and emergent situation, when the vessel has berthed in the night and has to sail before the next working day and the Assistant Commissioner is not available, the Preventive Officer at West Gate-I, shall give the clearance after all required formalities have been duly completed and obtained post facto approval of the Assistant Commissioner (Export) on the next working day. The Assistant Commissioner shall before such post facto approval verify that all requirements have been duly competed. This Public Notice supersedes any other instructions/orders issued earlier in this regard. All the Trade Associations/Chamber of Commerce/Members of Regional Advisory Committees and Custom House Agents Association are requested to publicize the contents of this Public Notice among their members/constituents.
