No. EDI-02/2017-CC ACC Date: 24.5.2017 FACILITY NOTICE No. 04/2017 Sub: Exemption from levy of charges for late filing of Bill of Entry -Reg. Attention of all the Custom House Brokers, Exporters/ Importers, Trade, Customs Staff and Stakeholders is invited to the Circular No. 12/2017-Cus dated 31.3.2017 and Public Notice No. 11/2017 dated 4.4.2017 concerning changes in the provisions of Section 46 and 47 of the Customs Act, 1962. 2. The ICES was functioning erratically on 22.5.2017 due to which the trade has represented that they could not file Bills of Entry as per the period stipulated under Section 46 of the Customs Act, 1962 and Regulation 4 (1) of the Bill of Entry (Forms) Regulations, 1976. 3. As a measure of trade facilitation, it has been decided that for the consignments having entry inward date 20.5.2017 or 21.5.2017 for which 22.5.2017 was the last date for filing BE without payment of late filing charges, there will be no charge on late presentation of Bill of Entry till 23.5.2017. However, there will not be any exemption if the BE was filed after 23.5.2017 or if no evidence is produced to show that job for filing BE was submitted but no positive acknowledgement was received from ICES for such consignments. 4. Difficulties faced, if any, may be brought to the notice of the undersigned at the earliest. This is issued with the approval of Principal Commissioner of Customs (Import).
