Trade Notice No. 05/2016 Subject: Simplification of Export procedure- Procedure where bonds can be furnished with Deputy/ Assistant Commissioner of Central Excise-Reg. Kind attention of the Trade Association/ Chambers of Commerce and the members of the RAC/PGC is invited to Trade Notice No. 07/2013 dated 03.07.2013 wherein this Commissionerate had designated Deputy/ Assistant Commissioner, Central Excise, Technical of Head Quarter office, Ahmedabad- III as DEPUTY COMMISSIONER/ ASSISTANT COMMISS10NER (EXPORTS) to discharge a similar function as was being discharged by the existing Maritime Commissioner, so far as the exports under rule 19 of Central Excise Rules, 2002 is concerned as per CBEC circular No. 500/66/99-CX dt. 15.12.1999 issued from F. No. 209/24/99-CX.6. 2 At present the Deputy/ Assistant Commissioner, Central Excise, (Technical) Head Quarters Ahmedabad-III is exercising/ discharging function as the Assistant/ Deputy Commissioner (Exports) to accept General Bond (Security- Surety Bond)/ issue of CT 1 / accept issue Proof of Export etc. for the Merchant Exporters falling under the jurisdiction of the Central Excise, Ahmedabad-III Commissionerate, as is being discharged by existing Maritime Commissioners, so far as the exports without payment of duty (Under Bond) under Rule 19 of the Central Excise Rules, 2002 are concerned. 3 Consequent to issue of Notification No. 80/2003-CE (NT) dated 29.10.2003, amending the notifications No. 42/2001-CE (NT) dated 26.6.2001, Circular No. 770/3/2004-CX dated 9th January 2004 issued by C.B.E.C. from F. No. 209/01/2003-CX.6, which envisages that for exports under bond without payment of duty under notification No.42/2001-CE (NT) dated 26.6.2001, as amended vide notification No. 80/2003-CE (NT), as per condition (i) of the said notification, the exporter shall furnish a general bond in the specified Form to the Assistant/ Deputy Commissioner of Central Excise having jurisdiction over the factory, warehouse or such approved premises, as the case may be, or the Maritime Commissioner or such other officer as authorized. This position also continues to remain the same after the aforesaid amendments. 3 Therefore with a view to mitigate the hardship to the trade/ exporters and in consonance with condition no 1 of notification No. 42/2001-CE (NT) dated 26.6.2001, in partial modification, now all the jurisdictional Central Excise Deputy/ Assistant Commissioner of Central Excise Commissionerate Ahmedabad-III are hereby designated as Deputy/ Assistant Commissioner (Export) to discharge a similar function for the merchant exporters falling under their respective jurisdiction (under whose jurisdiction office/ factory of the merchant exporter is located), as is being discharged by existing Maritime Commissioners, so far the exports under Rule 19 of the Central Excise Rules, 2002 are concerned. The list of jurisdictional Deputy/ Assistant Commissioners and their jurisdiction are uploaded on web site of the Commissionerate. www.cenexahmedabad3nic.in 04. To obviate the difficulty of the existing merchant exporters who have already executed the bond(s) for export of goods under Rule 19 of the Central Excise Rules, 2002 read with Notification No. 42/2001-CE (NT) dated 26.06.2001 with the Deputy/ Assistant Commissioner-(Export), HQ, Ahmedabad-III, which are valid till 31.03.2016, in such cases, on expiry of the validity of Bond the same shall be discharged at Head Quarters level only. It has been further decided that effective from 1st April 2016 a merchant exporter who desires to export the goods under bond shall execute a fresh bond including renewal of existing bond (which is live and valid even after 31.3.2016) shall on expiry of validity, will be executed before the newly designated Deputy/ Assistant Commissioner (Export), only. 05. Further, Commissioner has delegated the power to the Superintendent (Tech) in charge of Export/ Bond in each division to issue and cancel the CT-1 certificates to Merchant exporters who have executed the bonds with the Deputy/ Assistant Commissioner (Export). This Trade Notice shall come into force with effect from 1st April 2016. All Trade Associations/ Chamber of Commerce and the Members of the RAC/ PGC are requested to bring this to the notice of their members/ constituents. All JDC/JAC of C.
